Last updated: September 27, 2026

Article 1 – Identification of the Seller

These General Terms and Conditions of Sale are provided by:

Karamatou Lubangi Mutoke – Sole trader
Trading name: KAARA LU
Registered office: 15 rue Defresne Bast, 95100 Argenteuil, France
SIREN: 102 866 746
SIRET: 102 866 746 00013
Intra-Community VAT number: FR85102866746
Registration: National Business Register (RNE)
Email: Contact@kaaralu.com

Hereinafter referred to as “KAARA LU” or the “Seller”.

Article 2 – Purpose and Scope

These General Terms and Conditions of Sale, hereinafter referred to as the “Terms and Conditions”, govern the sale of products on the KAARA LU website to consumers acting for personal purposes.

They define the rights and obligations of KAARA LU and the customer in connection with product presentation, ordering, payment, delivery, returns, refunds and warranties.

By placing an order, the customer agrees to these Terms and Conditions before payment.

The applicable Terms and Conditions are those in force at the time the order is confirmed.

Clothing rentals intended in particular for stylists, audiovisual productions, photo shoots, artists, public figures or events are not governed by these Terms and Conditions. They are subject to a separate rental agreement specifying, in particular, the rental period, security deposit, conditions of use and liability in the event of loss or damage.

Article 3 – Customer

The customer declares that they have the legal capacity required to enter into a contract and place an order.

When placing an order, the customer must provide accurate, complete and up-to-date information.

KAARA LU products are sold at retail for personal and non-commercial use.

Unless prior written authorisation has been granted, purchases intended for resale, commercial distribution or professional use of the products are prohibited.

KAARA LU may limit purchases to two units of the same product reference in the same size per order, unless prior approval has been granted.

An order involving abnormal quantities or objective indications that the products are being purchased for resale may be refused or cancelled.

Article 4 – Products

KAARA LU sells, in particular, clothing, ready-to-wear items, shoes, bags, costume jewellery, accessories and fashion products.

The essential characteristics of each product are presented on its product page before the order is placed, including, where applicable:

- its description;
- its composition;
- available sizes;
- its fit;
- its dimensions;
- its colour;
- its main characteristics;
- its care instructions;
- and, for made-to-order items, the estimated production time before dispatch.

The customer must review this information before placing an order.

Photographs and videos are produced in order to represent the products as accurately as possible.

Slight differences in colour, texture or appearance may nevertheless occur depending on the screen used, lighting, material or the individual characteristics of each piece.

Such variations do not necessarily constitute a lack of conformity where they do not alter the essential characteristics of the product.

Article 5 – Prices

For orders delivered in France, prices are displayed in euros, including all applicable taxes.

Shipping charges are not included in the product price. Their amount is displayed before the order is finally confirmed.

KAARA LU may change its prices at any time.

The price charged to the customer is the price displayed at the time the order is confirmed.

In the event of an obvious pricing error that clearly does not correspond to the actual value of the product, KAARA LU may refuse to confirm or may cancel the order.

The customer will be informed and any amount already paid will be refunded.

Article 6 – Orders

The customer selects the products they wish to order and adds them to their cart.

Before payment, the customer can check:

- the selected products;
- sizes and quantities;
- prices;
- shipping charges;
- their identity;
- billing address;
- shipping address.

The customer is responsible for correcting any errors before confirming the order.

The final order confirmation button clearly indicates that placing the order creates an obligation to pay.

After confirmation, the customer receives an order summary by email at the address provided when placing the order.

KAARA LU may request additional information where verification is necessary to prevent fraud or secure the transaction.

KAARA LU may refuse or cancel an order, in particular in the event of:

- payment failure or payment issues;
- clearly incorrect information;
- reasonable suspicion of fraud;
- exceptional product unavailability;
- an abnormal order;
- a purchase showing objective indications of resale;
- or a previous dispute concerning payment for an order.

Where an order that has already been paid for is cancelled by KAARA LU, the amounts received will be refunded.

Article 7 – Availability

Products available in stock are offered subject to availability.

Adding a product to the shopping cart does not constitute a reservation.

Certain items may also be offered on a made-to-order basis and produced after payment has been confirmed.

In such cases, the product page will state that the item is made to order and will indicate the estimated production time.

If a product that was available in stock becomes unavailable after an order has been placed, KAARA LU will promptly inform the customer.

Depending on the circumstances, the customer may then choose:

- another product of equivalent value;
- to wait for a restock, where one is planned;
- or to receive a refund for the unavailable product.

No replacement will be imposed without the customer’s agreement.

Article 8 – Payment

Payment is due in full at the time the order is placed.

Available payment methods may include:

- bank cards;
- Visa;
- Mastercard;
- American Express;
- Cartes Bancaires;
- Apple Pay;
- Shop Pay;
- PayPal;
- Klarna;
- and any other payment methods displayed at checkout.

The payment methods actually available may vary depending on the customer’s country and the store settings.

Transactions are processed by secure payment providers integrated with Shopify.

KAARA LU does not have access to the customer’s complete banking details.

The order is processed only after payment has been confirmed.

If payment is declined, the order cannot be confirmed.

Article 9 – Retention of Title

Products remain the property of KAARA LU until the full price of the order has been paid.

This provision does not prevent the transfer of risk to the customer under the conditions provided by law.

Article 10 – Delivery

KAARA LU offers delivery in France and internationally, subject to the availability of shipping services for the selected destination.

Depending on the destination and selected method, delivery may be handled in particular by:

- Colissimo;
- Chronopost;
- UPS;
- Mondial Relay;
- or any other carrier offered during checkout.

For items available in stock, orders are generally prepared and handed over to the carrier within 2 to 5 business days following payment confirmation.

This processing period does not include the carrier’s transit time.

For made-to-order items, the production time indicated on the product page is added to the carrier’s transit time.

The estimated delivery date or period, shipping method and corresponding charges are displayed before payment.

Saturdays, Sundays and public holidays are not considered business days.

Certain orders, particularly high-value orders, may require a signature or delivery code upon receipt.

Detailed delivery terms are set out in the Shipping Policy available on the website.

Article 11 – Shipping Address

The customer is responsible for ensuring that the shipping information provided is accurate and complete.

In particular, the customer must check:

- recipient name;
- address;
- building;
- floor;
- postal code;
- city;
- country;
- telephone number.

Any error must be reported promptly to:

Contact@kaaralu.com

An address change cannot be guaranteed after the order has been shipped.

Additional costs directly caused by an incorrect or incomplete address may be charged to the customer where justified.

Article 12 – International Delivery and Customs

Orders delivered outside the European Union may be subject to:

- customs duties;
- import taxes;
- administrative fees;
- or other charges imposed by the destination country.

Unless expressly stated otherwise before the order is placed, these amounts are not included in the price paid to KAARA LU and remain the responsibility of the recipient.

KAARA LU does not currently collect customs duties or import taxes on behalf of authorities in countries outside the European Union, unless otherwise indicated at checkout.

The customer must check the import rules applicable in their country before placing an order.

KAARA LU does not control decisions made by customs authorities or the amount of any taxes that may be imposed.

If the customer refuses to pay the required duties or taxes and the parcel is returned, costs directly resulting from that return may be deducted from the refund where they are attributable to the customer, properly documented and legally recoverable.

Article 13 – Transfer of Risk

Where the customer acts as a consumer, the risk of loss or damage passes to the customer when they physically take possession of the product, or when a third party designated by them, other than the carrier proposed by KAARA LU, takes possession of it.

KAARA LU remains responsible for proper performance of the order until delivery in accordance with applicable law.

Article 14 – Delay or Failure to Deliver

If delivery is delayed beyond the announced period, the customer is encouraged to contact KAARA LU so that the situation can be investigated.

Where delivery does not take place within the agreed period, the customer may request that KAARA LU complete delivery within an additional reasonable period.

If delivery still does not take place within that additional period, the customer may terminate the contract under the conditions provided by law.

The customer may terminate the contract immediately where KAARA LU refuses to deliver or where the delivery date constituted an essential condition of the order and this had been communicated to KAARA LU before the contract was concluded.

Any amounts due will then be refunded within the statutory period.

Article 15 – Receipt and Delivery Claims

The customer is encouraged to check the condition of the parcel when it is received.

If the parcel shows significant visible damage, the customer may refuse delivery.

If the customer accepts it, they are advised to record specific reservations on the delivery document where possible.

The customer must then promptly contact KAARA LU, providing their order number and, where possible:

- photographs of the parcel;
- photographs of the shipping label;
- photographs of the internal packaging;
- photographs of the product.

Failure to make reservations upon delivery does not automatically remove the consumer’s statutory rights.

If tracking shows that the parcel has been delivered but the customer has not received it, KAARA LU may open an investigation with the carrier.

A declaration of non-receipt, proof of identity or any other relevant document may be requested.

For signature-required delivery, the proof of delivery, signature, delivery code or information recorded by the carrier may be reviewed.

The appropriate solution will be determined in accordance with the outcome of the investigation and the Seller’s legal obligations.

Article 16 – Missing, Damaged or Incorrect Product

If a product is missing, damaged, defective or does not match the order, the customer must contact KAARA LU at:

Contact@kaaralu.com

The customer must provide the order number and, where possible, photographs showing the issue.

Where the damage, defect, error or missing item is attributable to KAARA LU or the carrier, the customer will not be responsible for the necessary costs of return, replacement or redelivery.

This procedure does not limit any statutory warranties.

Article 17 – Right of Withdrawal

The customer has 14 days from receipt of the order to inform KAARA LU of their decision to withdraw, without having to provide a reason.

Where several products from the same order are delivered separately, the period begins on the date the last product is received.

To exercise this right, the customer may:

- use the online feature for exercising the right of withdrawal available on the website;
- send a clear statement to Contact@kaaralu.com;
- or use the standard withdrawal form provided at the end of these Terms and Conditions.

The statement must make it possible to identify the customer, the order and the products concerned.

After notifying KAARA LU of the decision within the statutory period, the customer has an additional 14 days to return the items.

Article 18 – Return Costs and Arrangements

Except where a product is defective, damaged, incomplete or does not conform to the order, the direct cost of return is borne by the customer.

Where the service is available for the customer’s destination, KAARA LU may provide a prepaid return label.

The customer will then not have to pay anything upfront when sending the parcel.

The cost of the label, communicated before confirmation, will be deducted from the refund.

If no prepaid return label can be provided, the customer must arrange and pay for the return directly with the carrier of their choice.

We recommend using a tracked shipping service and keeping proof of postage until the return has been fully processed.

Return instructions and the return address are provided after the request has been made.

The address normally used is:

KAARA LU – Returns Department
15 rue Defresne Bast
95100 Argenteuil
France

Depending on the country and carrier, a different return address may be provided.

Article 19 – Condition of Returned Products

The customer may handle or try on a product only to the extent necessary to establish its nature, size, fit and characteristics.

Items must be returned:

- unworn other than for a reasonable fitting;
- unwashed and uncleaned;
- unaltered and undamaged;
- free from stains, marks or tears;
- free from traces of make-up, foundation or deodorant;
- free from perfume, perspiration, smoke or any other odour;
- with their tags, accessories and protective elements;
- and, where still possible, in their original packaging.

The customer must take appropriate precautions when trying on items, particularly with make-up, perfume, cosmetics and jewellery.

Article 20 – Reduction in Value of Returned Items

Each returned item is inspected.

The customer may be held responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, size and characteristics of the product.

If the item shows stains, odours, signs of wear, damage, washing, alteration or any other deterioration attributable to the customer, KAARA LU may reduce the refund in proportion to the actual loss in value.

Where the product has been made unsuitable for resale and has lost its entire commercial value, the reduction may correspond to the full value of the product, subject to objective justification.

The condition of the product may be documented with photographs upon receipt.

Removing a tag does not automatically remove the right of withdrawal.

However, this may be taken into account if the removal has caused an actual reduction in the value of the product.

Article 21 – Refunds

Where a valid right of withdrawal is exercised, KAARA LU will refund the amounts due within the statutory period.

The refund will be made using the same payment method used for the original order, unless the customer expressly agrees to another method.

Store credit or a gift card may be offered, but will never be imposed instead of a refund to which the customer is legally entitled.

KAARA LU may withhold the refund until the products have been recovered or until proof that they have been sent back has been provided, whichever occurs first.

Where the customer withdraws from the entire order, the original delivery charges corresponding to the standard shipping method will be refunded.

Additional costs resulting from the customer’s choice of a more expensive shipping method than the standard option will not be refunded.

For a partial return, the original delivery charges will not be refunded where they would have been the same if the retained products had been ordered separately.

The cost of a prepaid return label may be deducted from the refund under the conditions set out in Article 18.

Article 22 – Size Exchanges

A size exchange may be requested within the return period, subject to availability.

The returned product must meet the same conditions as those required for a refund.

The requested size cannot be guaranteed or reserved before the returned item has been received and inspected.

If the requested size is no longer available, KAARA LU will offer:

- a refund;
- or, with the customer’s express agreement, store credit or a gift card.

Except where KAARA LU made an error or the product is defective, the direct return costs and any additional shipping costs associated with an exchange are borne by the customer.

The amount will be communicated before the exchange is confirmed.

Article 23 – Exceptions to the Right of Withdrawal

In accordance with applicable law, the right of withdrawal cannot, in particular, be exercised for products made to the customer’s specifications or clearly personalised.

This exclusion will be clearly stated on the product page before the order is placed.

The fact that a product is manufactured after the order is placed does not necessarily mean that it is personalised.

A product made in a standard size, fit or configuration offered by KAARA LU remains distinct from a product made according to the customer’s specific requirements or clearly personalised.

Exceptions to the right of withdrawal do not remove statutory warranties where a product is defective or does not conform to the order.

Article 24 – Made-to-Order Items

Certain KAARA LU products may be produced after the order has been confirmed.

This is stated on the product page before purchase.

The estimated production time is also indicated before the order is placed and is added to the carrier’s transit time.

For the structured faux-leather jacket, the current estimated production time is 2 to 4 weeks before dispatch.

This timeframe is an estimate and may change depending on production.

If there is a significant change to the announced timeframe, the customer will be informed as soon as possible.

The fact that an item is made after the order is placed does not remove the customer’s statutory rights.

Where the item is offered in a standard size, fit and configuration, it is not automatically considered a personalised product.

Article 25 – Statutory Warranties

Products sold by KAARA LU benefit from the statutory guarantee of conformity provided for in Articles L. 217-1 to L. 217-32 of the French Consumer Code and the warranty against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.

To exercise a warranty right, the customer may contact:

KAARA LU
15 rue Defresne Bast
95100 Argenteuil, France
Contact@kaaralu.com

Mandatory Information on Statutory Warranties

The consumer has a period of two years from delivery of the goods to invoke the statutory guarantee of conformity where a lack of conformity appears.

During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

Where the contract for the sale of goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory guarantee applies to that digital content or digital service throughout the agreed supply period.

During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.

The statutory guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without significant inconvenience.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests repair but the seller requires replacement instead, the statutory guarantee of conformity is renewed for a period of two years from the date of replacement.

The consumer may obtain a reduction in the purchase price while keeping the goods or terminate the contract and receive a full refund in exchange for returning the goods if:

1. the professional refuses to repair or replace the goods;

2. the repair or replacement takes place after a period of thirty days;

3. the repair or replacement causes significant inconvenience to the consumer;

4. the lack of conformity persists despite an unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or termination of the contract where the defect is sufficiently serious to justify an immediate remedy.

The consumer is not entitled to terminate the sale where the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the repaired or replacement goods are delivered.

The consumer also benefits from the statutory warranty against hidden defects for a period of two years from discovery of the defect.

This warranty entitles the consumer to a reduction in the price if the product is kept or to a full refund in exchange for returning the product.

Article 26 – Care and Use

The customer must follow the care instructions shown on the product label or product page.

KAARA LU cannot be held responsible for deterioration resulting in particular from:

- washing or cleaning contrary to the instructions;
- improper use;
- an accident;
- an alteration made by the customer or a third party;
- or normal wear and tear.

This provision does not limit any applicable statutory warranties.

Article 27 – Liability

KAARA LU is responsible for the proper performance of its obligations under the conditions provided by law.

However, KAARA LU cannot be held responsible for damage resulting from:

- improper use of the product;
- failure to follow its care instructions;
- fault on the part of the customer;
- or an unforeseeable and unavoidable act attributable to a third party.

Nothing in these Terms and Conditions may exclude or limit mandatory consumer rights or any liability that cannot legally be excluded.

Article 28 – Force Majeure

KAARA LU cannot be held responsible for any delay or failure to perform resulting from an event of force majeure within the meaning of French law.

Where the impediment is temporary, performance of the relevant obligation is suspended for the duration of the event.

If the impediment becomes permanent, the consequences provided for by applicable law will apply.

Article 29 – Intellectual Property

The KAARA LU trademark, its creations, collections, designs, drawings, sketches, prints, photographs, videos, texts, logos, graphic elements and content are protected by intellectual property laws.

Any reproduction, representation, adaptation, distribution or exploitation, in whole or in part, without prior written authorisation is prohibited, except where permitted by law.

The purchase of a product does not transfer any intellectual property rights to the customer.

Article 30 – Personal Data

Personal data collected is used in particular for the management of:

- orders;
- payments;
- deliveries;
- returns;
- refunds;
- customer service.

Full details of processing activities and the rights of individuals are set out in the Privacy Policy available on the website.

Any request may be sent to:

Contact@kaaralu.com

Article 31 – Evidence and Record Keeping

Electronic records, order confirmations, electronic communications, payment data and delivery information are retained under conditions designed to preserve their integrity and may constitute evidence in accordance with applicable law.

Contracts and documents are archived for the legally required retention periods.

Article 32 – Complaints

For any complaint, the customer must first contact KAARA LU:

By email:
Contact@kaaralu.com

By post:
KAARA LU
15 rue Defresne Bast
95100 Argenteuil
France

The customer is encouraged to provide:

- their identity;
- their order number;
- details of the issue;
- the requested solution.

Article 33 – Governing Law and Disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, the customer and KAARA LU are encouraged to first seek an amicable solution.

If no amicable solution can be reached, the consumer may bring the matter before the competent court in accordance with applicable legal rules.

A consumer residing in another country retains the benefit of any mandatory consumer protection provisions applicable in their country of residence where such provisions cannot be excluded by contract.

Article 34 – Changes to the Terms and Conditions

KAARA LU may amend these Terms and Conditions in order to reflect changes to:

- its business;
- its services;
- its operations;
- or applicable regulations.

The Terms and Conditions applicable to an order are those accepted at the time the order is placed.

Any subsequent amendment does not change the terms applicable to an order that has already been concluded.
