The website is hosted by Shopify, which provides the e-commerce platform enabling KAARA LU to present and sell its products.
2. Purpose
These Terms of Use define the rules applicable to access to and use of the KAARA LU website, including when browsing content, creating an account where available, subscribing to the newsletter or using the features provided.
Sales made through the website are governed by the General Terms and Conditions of Sale and supplemented, in particular, by the Shipping Policy, Refund Policy and Privacy Policy.
By accessing the website or using its features, the user acknowledges having read these Terms of Use.
3. Access to the Website
The website is normally accessible at all times, subject to maintenance operations, updates, technical incidents, interventions by service providers or events beyond KAARA LU’s control.
KAARA LU may temporarily suspend all or part of the website where necessary to ensure maintenance, security or proper operation.
KAARA LU does not guarantee that the website will be continuously available or free from technical errors.
However, KAARA LU will endeavour to restore normal operation as quickly as possible in the event of an incident.
4. Use of the Website
The user agrees to use the website fairly, lawfully and in accordance with its intended purpose.
In particular, users must not:
- use the website for fraudulent, unlawful or unauthorised commercial purposes;
- attempt to gain unauthorised access to the website’s systems, accounts or data;
- introduce viruses, malicious software or any element capable of disrupting the operation of the website;
- bypass security or protection measures;

- impersonate another person;

KAARA LU may restrict or suspend a user’s access in the event of fraudulent or abusive use or use likely to compromise the security of the website, without prejudice to any other available remedies.

KAARA LU endeavours to provide information that is as accurate, complete and up to date as possible.
However, typographical errors, omissions or display differences may occur.
KAARA LU may correct or update information on the website where an error is identified.
Photographs and videos are produced in order to represent the products as accurately as possible.
Slight differences in colour, texture or appearance may occur depending on the screen used, lighting, materials or the individual characteristics of each item.
The essential characteristics, composition, available sizes, care instructions, applicable price and, for made-to-order items, the estimated production time are stated on the product page before the order is placed.
6. Products, Prices and Availability
Products available in stock are offered subject to available quantities.
Certain KAARA LU products may also be offered on a made-to-order basis and produced after the order has been confirmed.
Where this applies, it is stated on the product page before purchase together with the estimated production time.
Adding a product to the shopping cart does not constitute a reservation.
The sale becomes final under the conditions set out in the General Terms and Conditions of Sale, after the order has been confirmed and payment has been approved.
Applicable prices, taxes, shipping charges and any information relating to customs duties are displayed before the order is confirmed.
KAARA LU may change its products, prices, collections and services at any time.
Such changes do not affect orders that have already been confirmed.
7. Orders and Payment
Any order placed through the website creates an obligation to pay.
The customer must provide accurate, complete and up-to-date information when placing an order, including information relating to their identity, billing address, shipping address and contact details.
KAARA LU may refuse or cancel an order in the event of:
- payment failure or payment issues;
- clearly incorrect information;
- reasonable suspicion of fraud;
- exceptional product unavailability;
- an order involving abnormal quantities;
- objective indications that products are being purchased for unauthorised resale.
Where KAARA LU cancels an order for which payment has already been received, the relevant amounts will be refunded in accordance with the applicable rules.

8. Personal Use and Resale
KAARA LU products are sold at retail for personal use.
Unless prior written authorisation has been granted, customers may not purchase products for the purpose of reselling, distributing or commercially exploiting them.
KAARA LU may limit purchases to two units of the same product reference in the same size per order, unless prior approval has been granted.
This restriction does not apply to occasional product rentals agreed directly with KAARA LU.
Any rental intended in particular for a stylist, audiovisual production, photo shoot, public figure or event will be subject to separate terms and a separate rental agreement.
9. Customer Account
Where account creation is available, the user is responsible for the accuracy of the information provided and for maintaining the confidentiality of their login credentials.
Any activity carried out through an account is presumed to have been carried out by the account holder, unless fraudulent use has been reported to KAARA LU.
The user must promptly inform KAARA LU if they become aware of unauthorised use of their account or any compromise of their login credentials.
KAARA LU may suspend an account where there are objective indications of fraud, identity theft or abusive use.
10. Intellectual Property
The KAARA LU trademark, its distinctive signs, collections, creations, garments, designs, drawings, sketches, prints, photographs, videos, texts, logos, graphic elements, compositions, editorial content and website elements are protected by intellectual property laws.
Access to the website does not grant the user any ownership rights over these elements.
Any reproduction, representation, modification, adaptation, extraction, distribution or exploitation, in whole or in part, for commercial or professional purposes without KAARA LU’s prior written authorisation is prohibited, except where permitted by law.
In particular, KAARA LU photographs, videos, drawings or product pages may not be used to promote or sell products without authorisation.
11. Reviews, Messages and User-Submitted Content
Where the website allows users to publish a review, submit a comment or transmit content, the user guarantees that such content is lawful, genuine and does not infringe the rights of any third party.
The user remains the owner of the content they submit.
Where a review is voluntarily published on the website, the user authorises KAARA LU to display, format and reproduce it on the website for as long as necessary for its presentation, without altering its meaning.
Fraudulent, abusive, discriminatory, clearly misleading, irrelevant or rights-infringing content may be rejected or removed.

KAARA LU does not control their content or operation and cannot be held responsible for damage exclusively attributable to an independent third-party service.
This provision does not limit KAARA LU’s responsibility for its own obligations towards customers, particularly in relation to orders, payments, deliveries and statutory warranties.

Personal data collected through the website is processed in accordance with the KAARA LU Privacy Policy.
The use of certain cookies or tracking technologies that are not strictly necessary is subject to the user’s prior consent where required by applicable law.
Users may accept, refuse or change their preferences using the cookie management tool available on the website.
Cookies strictly necessary for the operation of the website, the shopping cart, security or the provision of a requested service may be used without consent where the applicable legal requirements are met.
14. Security
KAARA LU implements reasonable measures to protect the website and processed data against unauthorised access, loss, alteration or fraudulent use.
As no information system can guarantee absolute security, users are encouraged to protect their devices and access methods.
KAARA LU will never ask a customer to provide their password or complete banking information by email.
15. Liability
KAARA LU is responsible for performing its obligations under the conditions provided by applicable law.
However, KAARA LU cannot be held responsible for damage resulting from:
- unlawful use or use contrary to these Terms;
- incorrect information provided by the user;
- equipment, internet connections or third-party services outside its control;
- an event of force majeure within the meaning of French law;
- maintenance or security operations that are reasonably necessary.
Nothing in these Terms of Use may exclude or limit mandatory consumer rights, statutory warranties or any liability that cannot legally be excluded.
16. Suspension or Termination of Use
The user may stop using the website at any time.
KAARA LU may suspend or restrict access to a user in the event of fraud, an attempted security breach, a serious violation of these Terms or clearly abusive use.
Suspending access to the website does not affect rights and obligations arising from an order that has already been concluded.
17. Changes to the Terms of Use
KAARA LU may amend these Terms of Use to reflect changes to the website, its features, its business or applicable regulations.
The applicable version is the version published on the website on the date of use.
Changes to these Terms do not retroactively alter rights and obligations arising from orders that have already been confirmed.
The date of the latest update is stated at the beginning of this page.
18. Severability
If any provision of these Terms of Use is declared invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
KAARA LU’s failure to immediately exercise a right does not constitute a waiver of its right to exercise that right at a later date.
19. Governing Law
These Terms of Use are governed by French law.
Where a user acts as a consumer and resides in another country, they retain the benefit of any mandatory consumer protection provisions applicable under the law of their country of residence where such provisions apply.
